Domestic and international arbitration
Arbitration before Colombian and international centers and enforcement of awards.
We represent parties in domestic and international arbitration and advise them from the drafting of the arbitration agreement. We act under Law 1563 of 2012, Colombia's Domestic and International Arbitration Statute, and under the rules of the arbitration centers run by the country's chambers of commerce, including the Medellín Chamber of Commerce for Antioquia, and of international institutions such as the International Chamber of Commerce (ICC).
Arbitration resolves complex disputes before specialized arbitrators and within defined time frames. We help decide whether it makes sense to agree to it, under which rules, seat and language, and how to draft the clause so that it works and does not become the first point of contention.
We also handle the stages after the award: annulment proceedings, recognition of foreign awards under the 1958 New York Convention and enforcement before the Colombian courts.
What we do
- Drafting and reviewing arbitration clauses and submission agreements, including multi-tier clauses with prior negotiation and conciliation.
- Representation of claimants and respondents in domestic arbitration in law and in technical arbitration.
- International arbitration seated in Colombia or abroad, under institutional rules or ad hoc.
- Corporate, contractual, construction, energy and infrastructure disputes and disputes arising from the sale of companies.
- Disputes under government contracts submitted to arbitration.
- Interim measures before the arbitral tribunal or before the courts in support of arbitration.
- Annulment proceedings against domestic and international awards.
- Recognition and enforcement of foreign awards in Colombia.
- Amiable composition and conciliation as mechanisms prior or alternative to arbitration.
- Selection and challenge of arbitrators and coordination with technical and financial experts.
Questions we answer
- Should I agree to arbitration or go to the ordinary courts?
- Can I compel a counterparty that did not sign the contract containing the arbitration clause to arbitrate?
- What happens if the arbitration clause names a center that does not exist or is poorly drafted?
- Can I request an attachment while the arbitral tribunal is being constituted?
- Can an award be appealed?
- How do I enforce an award issued in New York or Paris in Colombia?
